Intellectual Property Policy

The Arqa Sakan platform retains all intellectual property rights associated with it, and is equally committed to respecting the intellectual property rights of others. This policy sets out the provisions governing the use of content published on the platform.

1. Scope of Protection

The intellectual property rights of the Arqa Sakan platform include, without limitation: the trade name, the logo, the design of the website and application, the software code, the databases, the texts, images, videos, and the marketing content published through the platform. These are protected under the copyright and intellectual property laws in force in the Kingdom of Saudi Arabia.

2. User-Submitted Content

By publishing a real estate advertisement or any content (images, descriptions, documents) through the Arqa Sakan platform, the user acknowledges that they are the lawful owner of that content or hold sufficient permission to publish it, and grants the platform a non-exclusive license to display that content within the scope of providing the service.

3. Prohibition of Unauthorized Use

Copying, republishing, distributing, or modifying any part of the platform's content (whether texts, designs, or data) without prior written permission from Arqa Sakan is prohibited, with the exception of personal, non-commercial use within the purpose for which the content was made available.

4. Reporting Intellectual Property Infringement

If any party believes that their intellectual property rights have been infringed through content published on the platform, they may submit a report via the "Complaints" page. The report must include, as a mandatory requirement:

  1. The full contact details of the reporting party.
  2. A precise identification of the work or right subject to the infringement, together with proof of ownership or entitlement to it.
  3. The exact link or location of the infringing content on the platform.
  4. A declaration by the reporting party confirming the accuracy of the information provided and accepting responsibility for any malicious or inaccurate report.

Arqa Sakan will not consider any report that does not satisfy these elements. It will review compliant reports and take the appropriate action (including temporarily removing the content pending verification) within the period specified in the complaints-handling policy, without this constituting an acknowledgment by the platform of the validity of the report or of its responsibility for content published by third parties.

5. Moral Rights

This policy does not prejudice the inalienable and non-assignable moral rights of original authors under the Saudi Copyright Protection Law, and the rights licensed to the platform are limited to the use set out in Section 2 above.

6. Amendments

Arqa Sakan reserves the right to amend this policy at any time, and any update will be published on this page together with the date of the last update.

The Arabic version of this policy is the authoritative version in the event of any conflict with the English translation.
