Welcome to the Arqa Sakan platform. Please read these terms carefully before using the platform or any of its services, as your use of the platform constitutes your express agreement to be bound by them.

1. Definitions

"Platform": the Arqa Sakan website and application, including all electronic services they contain.

"User": any natural or legal person who uses the platform, whether as an advertiser, a visitor, or a property seeker.

"Real Estate Advertisement": any data or content published on the platform for the purpose of marketing or offering a real estate unit.

2. Registration and Use Requirements

• The user must be 18 years of age or older and possess full legal capacity to contract under Saudi laws and regulations.
• The identity of advertisers is verified through the National Single Sign-On service (Nafath) before they are permitted to publish any real estate advertisement.
• The user undertakes to provide correct, accurate, and up-to-date information upon registration, and bears sole responsibility for any incorrect information they provide.

3. Advertiser's Material Representations

By publishing any real estate advertisement, the advertiser expressly represents and warrants to the platform that they:

• Are the actual owner of the property subject to the advertisement, or hold a valid legal authorization/power of attorney from the owner to market it, and will provide proof thereof immediately upon Arqa Sakan's request.
• Hold a valid real estate advertising license issued by the competent authority in accordance with the regulations of the Real Estate General Authority, and that all data (price, area, condition, images) accurately reflects reality.
• Comply with the anti-money laundering and counter-terrorism financing laws in force in the Kingdom with respect to any transaction arising from the advertisement, given that the real estate sector is a "Designated Non-Financial Business or Profession" subject to those laws.
• Will not use the platform for any fraudulent or misleading purpose or one that violates the laws in force in the Kingdom.

4. Arqa Sakan's Authority over Advertisements

Arqa Sakan reserves the right to review any advertisement at any time, and to suspend, remove, or hide any advertisement or advertiser account immediately and without prior notice in the event of suspected violation of the real estate advertising license, receipt of a report/complaint concerning it, or its violation of these terms or the applicable laws, without this giving rise to any liability on the platform toward the advertiser.

5. Limitation of Liability and Disclaimer of Warranties

Arqa Sakan operates solely as a technical intermediary for displaying real estate advertisements. It is not a party to any sale or lease contract concluded between the advertiser and the property seeker, and does not guarantee the accuracy, completeness, or continued availability of any data published by advertisers. The platform is provided "as is" without any express or implied warranties. To the maximum extent permitted by law, Arqa Sakan shall not be liable for any direct or indirect damage arising from the use of the platform or reliance on third-party content published on it, while remaining committed to taking the necessary actions upon receipt of complaints in accordance with the published complaints-handling mechanism.

6. Indemnification

Each user/advertiser undertakes to indemnify Arqa Sakan, its owners, and its employees against any claim, lawsuit, loss, or cost (including attorneys' fees) arising from their violation of these terms, the inaccuracy of their representations set out in Section 3, or content they publish through the platform.

7. Intellectual Property

The use of any content on the platform is subject to the Intellectual Property Policy published at: /intellectual-property-policy

8. Privacy

Users' data is subject to the Privacy Policy published on the platform and is processed in accordance with the Saudi Personal Data Protection Law (PDPL).

9. Complaints

Any user may submit a complaint regarding any advertisement or service through the dedicated "Complaints" page on the platform, and it will be handled in accordance with the published complaints-handling mechanism and timeframe.

10. Force Majeure

Arqa Sakan shall not be liable for any delay or failure in providing the service resulting from circumstances beyond its reasonable control, including major technical failures, outages of government services (such as Nafath), or disasters or other force majeure events.

11. Amendment of Terms and Termination of Service

Arqa Sakan reserves the right to amend these terms at any time, and continued use of the platform after an amendment constitutes acceptance of the updated terms. It also reserves the right to suspend the service in whole or in part, or to terminate the account of any user who violates these terms.

12. Language Precedence

The Arabic version of these terms is the authoritative and governing version in the event of any conflict with the English version or any other translation.

13. Governing Law and Dispute Resolution

These terms are governed by and construed in accordance with the laws and regulations in force in the Kingdom of Saudi Arabia. Any dispute shall be settled through the judicial or quasi-judicial bodies with subject-matter jurisdiction, which may include the dispute-resolution mechanisms of the Real Estate General Authority or the e-commerce dispute-settlement platform, depending on the nature of the dispute.
